This is in reference to the ongoing investigation going on in fraud connected with GTB by the Economic Offence wing in connection with Core Health care group. I had sent email on 20th September 2005 and I hope that the necessary steps have been initiated by you at your end.
I am enclosing copy of my recent complaint against Tax Recovery Officer and the assessing officer sent to the Ellis bridge Police station by post yesterday on 4-10-2005 . The text of the complaint is annexed herewith for your reference:-

In this connection necessary instructions were issued by the Home department to the office of Police Commissioner to extend protection in light of the letter from the Additional Principal Secretary to the Honorable Chief Minister of Gujarat . The same is appended here with for your reference once again as under:-

In light of above , I was called upon by Paldi Police Chawky ( under Ellisbridge Police station ) to furnish a reply and I had sent letter dated 20th July 2005 to Paldi Police station with a copy marked to Ellisbridge police station and Police commissioner's office . Thereafter , I have not received any communication from them in this regard.

Yesterday I have sent by speed post complaint against Tax Recovery Officer , assessing officer to the Ellisbridge Police station as well as Paldi Police chowky and the Police Commissioner office on account of the intimidation by the tax recovery officer to use coercive measures to extort taxes or silence me. This is likely being done by Core Health care group and their associates through the income tax department so as to silence me or that I succumb to them. The tax recovery officer has used such tactics in the past to extract taxes from wife and my children and they are likely to use the same tactics on my seeking information from the assessing officer vide my letter dated 12-9-2005. The reply has not been furnished for obvious reasons.
It would be unfair on the part of investigating authorities and police department to call any details from the undersigned till:-
· detailed reply from Jatin Jalundhwala and Oriental Bank of Commerce is furnished to me in light of my email to the crime department referring that the Police Inspector , Mr. J M Chaudhary, of Economic offence wing has been informed in light of my letters dated 26-5-2005 and 4-6-2005 addressed to him.

There is no system and process evolved to provide safety to whistleblower- witness inspite of the instructions of protection by the Honorable Chief Minister of Gujarat and for more than one year there is hardly any progress.
There is complete absence of the dignity and honour and the person has to accept the vulnerability of being harassed , humiliated while disturbing the old parents and affecting the personal lives.
Do we not deserve any respect when all we see is indifference to us every where and we the common citizen have to remain mute spectator ?
I feel helpless , perhaps the Government of India would learn how to protect a whistleblower , how to shoulder the responsibility to furnish detailed findings and action taken report, how to make whistleblowers secure and safe .
I am sorry to say that there is total chaos , negligence and carelessness on the part of the Police department when no system of coordination has been devised and when the Government does not feel to treat a citizen that they are obligated to protect and support.
Perhaps the administration of Government of Gujarat wants to tarnish the name of the Honorable Chief Minister of Gujarat especially when he has extended helping hand of protection to the undersigned as well as investigation of GTB fraud.
What else can I say – except that I remain a witness to such situation while the bank robbers like Core health care management go scot free.
I do hope that my some one understands and listens to the pain of whistleblower. I do hope that there is some Ram who wants to give helping hand to Jatayu fighting the system single handedly without any support from any one in the Government . I do hope that there is some one to give helping hand to Abhimanyu .
What else can I say except to wait for your prompt and detailed reply in this connection with necessary instructions to the Ellisbridge Police station to provide protection confirmed by your personal assurance by email to me.

This is in continuation to my earlier correspondence. . I had sent following email to ORIENTAL BANK OF COMMERCE while asking them to file a affidavt accepting or denying the statement while marking a copy to you and the undersigned. All I receive is legal threat of criminal defamation from them. I had asked OBC to mark a cpoy of affidavit to you and the undersigned. In case, I do not receive a reply from your end, it would be presumed that Oriental Bank of Commerce has not filed a copy of affidavit to you and tacitly the Home deparment confirms that their silence shows that the managment of OBC is guilty and there is every reason for the crime department to take immediate action against the bankers and the scamsters. In case , OBC has furnished an affidavit , I humbly request you to furnish a copy to me before I make on comments . Your support would be very much appreciated in unearthing the collusion of bankers with the party as well as for my personal safety. I have already received threat of legal action against me so that they are able to protect their acts of collusion with bank scamsters. The bankers have harassed me indirectly through their bank borrower through police by holding me to police remand in the past and they can go to any such tactics to harass a whistleblower who makes his whistle louder and persistent. I have reason to give up receiving any support of protection from the police department and we the common citizen has to be just remain a mute spectator. Sir, only your toughness with the police administration can change the situation. what more can a ordinary person expect. it is harsh reality that the police is interested in post mortem exercise and not taking up issues promptly by questioning OBC minutely inspite of the person communicating them way ahead so that their rights stay protected. It is time that the Home department winds up the police department in light of recent supreme court comments.Only you can take effective steps so that the the image of Government of Gujarat does not get tarnished and restore faith in the police administration where by they stop colluding with rich and powerful to influence the police. I am impressed by the quick attention given by the Honorable Chief Minister and his team but the same has not filtered down to the police administration and there is no system evolved to appraise and monitor the qualtiy of output as regards to the police department. The top officials of the Government of Gujarat has lot of hidden potential which needs to be capitalised so that the same becomes visible to the people of gujarat . Kindly refer to my earlier communication as per above reference for which the bank has not furnished detailed satisfactory reply backed by documentary evidences till date.
I have reason to believe that charge was already created by Core Health care much prior to August 1998 and hence, there was no reason for Jatin Jalunhwala to create a fresh charge subsequently in 1998 on the assets of Rupmangalam, Flovin, Dhanyushya. More so, when the charge created prior on assets of Core Health care was satisfied/paid in first quarter 1999 and replaced by another charge of Rs 12.5 crores on assets of RIPL, FPPL and DFL and Core health care in March 1999 .
This shows that this was done in collusion with the concerned officers as well as the management of GTB to let Core Health care dilute the security or let the responsible directors of Core Health care and Dhanyushaya Financial to avoid facing huge liabilities.
I therefore call upon Chairman and Managing Director, Executive Director and General Managers and Regional Director and Branch Manager of CG Road branch and Vidya Rudra of Oriental Bank of Commerce to furnish a copy of Notarized written affidavit before magistrate/judge either confirming that the charge was created prior to August 1998 by GTB management or denying that the charge was not created prior to August 1998 on assets of Core Healthcare.
A notarized copy of written affidavit before the Magistrate would be furnished to me at my email address latest by 23 rd August 2005 and followed up by dispatch in post to my email address as well as simultaneously to the Home Department of Government of Gujarat at their email address and the Registrar of Gujarat High High Court at their email address that you are fully satisfied wit the conduct of the Chairman & Managing Director of Core Health care as well as Mr. Jatin Jaludhwala and the concerned officers of GTB management. The email address of Home Department of Government of Gujarat is pshome@gujarat.gov.in . The email address of Gujarat High Court is hcguj@guj.nic.in . Kindly note that when you send email to me , it should be visible to me that you have simultaneously sent copy of email to Home Department and Highcourt of Gujarat .
In case ,all of you remain silent , then it is obvious that all of you confirm collusion with the directors of Core Health care , Jatin Jalundhwala and the concerned management of GTB to allow them to go scot free. By this email you are called upon to clarify your position in form of written affidavit either confirming or denying the charge creation by Core Health care prior to August 1998 and whether you have taken criminal action against them or not.
Kindly note that I have been receiving tacit threat from the persons unknown to me while strongly and aggressively suggesting and advising me to withdraw case pending against GTB and others and they have claimed that they have met OBC management and have been asked by OBC management to meet the undersigned so that I withdraw or settle the case.
I am therefore, constrained to send this letter for my personal safety to prevent any further harassment from the bankers directly or indirectly as in the past - the management of GTB had parted the contents of my private and confidential letter to the management of Core Health care with a view that I am silenced , harassed and subjected to police remand and hence , such tactics, are presumably being employed by the bank directly or indirectly for the reasons best known to you and your management staff in connivance with Core healthcare and its employees and their advocates and their chartered accountants including Mr and Mrs Sushil Handa.
The present issue is over and above to the issues raised in earlier emails addressed to you and I reserve my right to take up other issues from time to time with you and/or authorities.
I look forward to your immediate acknowledgment as well as reply in this connection as part of courtesy as a banker to the citizens of the country.
